Letters Testamentary &
Will Administration
Probate is the process after death of dividing the estate with the court's supervision. The goal of probate is the fast, efficient, and smooth transfer of estate assets in accordance with the wishes of the deceased.
With the legal counsel of a probate attorney, probate can be a fairly simple legal process. With extensive experience in dealing with issues in probate law, Brandy Baxter-Thompson understands that probate can be an emotional process for people who recently experienced the loss of a loved one. Our goal is to make the process as simple and stress-free as possible.
One of the major topics in probate law is the issue of will administration. If the deceased has left a will, they will usually have named an executor in their will. The executor is named in what is called the letters testamentary and acts as the personal representative of the deceased person's estate and is empowered by the court to take any action necessary to settle the estate without having to ask the probate court for permission every step of the way. The executor's job is to gather the assets, pay the required debts, and distribute the remaining assets to the beneficiaries as named in the will.
When the deceased has not left a will or letters testamentary, the options are limited to a few specific ways to handle the estate. Unfortunately, these options do not always work and you will be required to ask the probate court for a dependent administration. Although dependent administration can be time consuming and expensive, the costs can be borne by the estate.
